I have the hencur to acknowledge your despatch of
the 16th instant which arrived as I was about to answer
that of the 18th august with reference to which & har
the hencur to telegraph to yeu that I agreed generally
with .r. Turner' views as to deportation by executive or
der. 1 gather that he is of opinion that as a war nge-
sure the retic val of the paracns contemplated in your despatch should be affected by your exncu,ive order. y
object in answering at once whilst away from Janghai
and without access to books and decuments was to assure
you that if you think such powers necessary and they culi
be conferrad 1 certainly concur in their grant.
...ith regard to the present powers of the Courts –
de not say they are adequate, but 1 think i cught to Bay
that they have not been tried and as i had the hencur
to point out to you on a previcus occasion the action of
the Court in deportation cases was entirely misrepresent -
ed to you, i should not have adverted to this incident
had it not been that you refer to the failure to socure
the deportation of twe indians from Japan and attribute
that failure to the difficulty of dealing with then herA
i dont know wh- advised you as to that difficulty, but
1 de not think I should have found any, and 1 have little
doubt that had the men been brought before 29, 1 should
have crdared their immediate deportation to India, ihás,
however, does not cover all the cases suggested by .ir.
Petrie, and if extended powers are required & am quite
certant
